CRCA/ECPAT Shqipëri shpreh habinë dhe shqetësimin e saj sesi institucionet nuk kanë vepruar deri më sot në mbrojtje të fëmijëve.
Tiranë, 6 Prill 2021 - CRCA/ECPAT Shqipëri, Platforma Kombëtare ISIGURT.al dhe Zyra e Mbrojtjes Ligjore Falas për Fëmijët dhe të Rinjtë në Shqipëri, me anë të kësaj kërkese publike drejtuar tre institucioneve publike në Shqipëri: Komisionerit për Mbrojtjen e të Dhënave Personale, Policisë së Shtetit dhe Drejtorisë së Përgjithshme të Gjendjes Civile, duan të shprehin shqetësimin e tyre për ekzistencën e një faqeje në internet, e cila mundëson marrjen online në çdo kohë të informacionit personal të çdo shtetasi shqiptar.
Bazuar në disa raportime të bëra pranë Platformës Kombëtare i SIGURT.al, ekspertët e CRCA/ECPAT Shqipëri dhe Zyrës së Mbrojtjes Ligjore Falas për Fëmijët dhe të Rinjtë në Shqipëri, u vunë në dijeni se prej kohësh, online, ekziston një adresë shqiptare, e cila rrezikon seriozisht bërjen publike të identitetit të fëmijëve në të gjithë Shqipërinë, përfshi edhe adresën e tyre. Në këtë faqe gjenden lehtësisht të dhënat sensitive dhe adresat e shtetasve shqiptarë, përfshirë këtu edhe ato të fëmijëve nën moshën 18 vjeç. Me një kërkim të thjeshtë në këtë faqe, aksesohen të dhëna personale dhe sensitive të përsonit në fjalë, por edhe adresa të mirëfillta të vendbanimeve, statusi civil dhe familja dhe gjithçka tjetër, sikur të ishte një zyrë e mirëfilltë e Gjëndjes Civile.
Në bindjen tonë kjo faqe rrezikon seriozisht jetën dhe sigurinë e fëmijëve në Shqipëri, duke qenë lehtësisht e aksesueshme nga pedofilët dhe grabitqarët seksualë. Për më tepër, nëse kërkon të dhëna edhe më personale për një shtetas, pronarët e adresës kërkojnë që të paguhet për marrjen e të dhënave, bazuar në numrin e kërkimeve që ke bërë në faqe. Kjo ngre dyshime të forta, jo vetëm për mënyrën e përdorimit të të dhënave personale të shtetasve shqiptarë, që ligjërisht supozohet se janë të mbrojtura, ndërkohë që ato gjenden publike apo shiten për përfitime materiale online.
Neni 17 i Ligjit 18/2017 “Për të drejtat dhe mbrojtjen e Fëmijës”, garanton mbrojtjen e privatësisë së fëmijëve në çdo lloj situate. Fakti që të dhënat personale dhe sensitive të fëmijëve gjendjen online, do të thotë që shteti shqiptar dhe institucionet e saj kanë lejuar një faqe publike në Shqipëri të shkelë me të dyja këmbët ligjin dhe sigurinë e fëmijëve.
Kjo adresë gjithashtu bie në kundërshtim të hapur me Ligjin nr. 9887, datë 10.03.2008 “Për mbrojtjen e të dhënave personale”, i cili sqaron se të dhënat personale të çdo individi duhet të publikohen, përpunohen, apo edhe identifikohen vetëm në bazë të dhënies së pëlqimit nga çdo person. Gjithashtu referuar nenit nr. 28 të po këtij ligji, kontrolluesit, përpunuesit dhe personat, që vihen në dijeni me të dhënat e përpunuara, gjatë ushtrimit të funksioneve të tyre, detyrohen të ruajnë konfidencialitetin dhe besueshmërinë edhe pas përfundimit të funksionit. Këto të dhëna nuk përhapen, përveç rasteve të parashikuara me ligj.
Referuar Nenit 27/2-b në Ligjin nr. 9887/2008, në të cilin shpjegohet qartë se përdorimi i të dhënave bëhet me urdhër të njësive organizative ose të operatorëve të autorizuar. Nga të gjitha komunikimet që CRCA/ECPAT Shqipëri ka zhvilluar me institucionet pub;ike, përgjegjëse për mbledhjen, përpunimin dhe ruajtjen e të dhënave personale të cdo shtetasi shqiptar, rezulton se kjo faqe nuk administrohet nga një institucion publik përgjegjës, që ka të drejtën ligjore për të administruar të dhëna personale dhe sensitive për çdo shtetas dhe specifikisht për fëmijët në Shqipëri.
Përsa më sipër, CRCA/ECPAT Shqipëri, Zyra e Mbrojtjes Ligjore Falas për Fëmijët dhe të Rinjtë në Shqipëri dhe Platforma Kombëtare ISIGURT.al ju drejtohen institucioneve të mësipërme, për të kryer identifikimin e personave përgjegjës apo njësive që e kanë vënë në përdorim këtë faqe, si dhe mbylljen e saj urgjente, në mënyrë që të sigurohet mbrojtja e të gjitha të dhënave sensitive për çdo fëmijë në Shqipëri.

Personal data of children in Albania at risk of falling into the hands of pedophiles!
CRCA / ECPAT Albania expresses its astonishment that data protection institutions have not acted to date to protect children.
Tirana, April 6, 2021 - CRCA / ECPAT Albania, the Free Legal Office for Vulnerable Children and Youth and the National Platform ISIGURT.al, through this public call addressed to three public national institutions: the Commissioner for Data Protection, National Police Authority and the Directorate for the Civil Registrar, express our concern on the existence of an Albanian language website, which enables receipt online of extremely sensitive and personal information for every citizen in Albania.
Based on several reports made to the National Platform SIGURT.al, the experts of CRCA / ECPAT Albania and the Free Legal Office for Vulnerable Children and Youth, were informed that there is an Albanian webpage, which seriously endangers making public the identity of children throughout Albania, including sensitive data as their exact address. The page can be easily found. A simple search on the page, gave us access to personal and sensitive data, including the address, residency, civil and family status etc., as if we were accessing data of the Civil Registry office.
In our opinion, such a website seriously puts in danger the life and safety of children in Albania, because it is easily accessible by pedophiles and sexual predators. Furthermore, if one requests further detailed personal information, the owners of the website ask visitors to purchase other data, based on the number of searches and views you have had on the website. This raises the second question, not only on the manner how our personal data are used by an unauthorized party for business purposes, when such data are legally assumed to be protected, and not sold for material benefits online.
Article 17 of Law 18/2017 "For the protection and the Rights of the Child", guarantees the protection of children's privacy in any given situation. The fact that the personal and sensitive data of children are online, it means that the Albanian institutions have allowed this webpage to violate the law and the safety of children.
The web-address is also in total contradiction with Law no. 9887, dated 10.03.2008 "On data protection", which clarifies that personal data of everyone must be published, processed, or even identified only based on giving consent by each person. Article no. 28 of the same law, states that controllers, processors, and persons who are made aware of the processed data, during the exercise of their functions, are obliged to maintain confidentiality even after the end of the function.
Article 27/2-b in Law no. 9887/2008, clearly explains that the use of personal data is done by order of organizational units or authorized operators. From all the communications that CRCA/ECPAT Albania has had so far with several public institutions, responsible for the collection, processing, and storage of personal data, it results that the site is not administered by a responsible public institution, which has the legal right to administer personal and sensitive data for each citizen.
Regarding the above, CRCA/ECPAT Albania, the Free Legal Aid Office for Vulnerable Children and Youth and the National Platform ISIGURT.al use this opportunity to ask the responsible public institutions to identifying the responsible persons or units that have provided this website with sensitive data and information, in order to ensure the protection of all sensitive data and information for children in Albania.
